Q:  I have a personal injury lawyer but my case is not progressing, can I call another lawyer?

A:  If a person is represented by a lawyer, another lawyer is not allowed to speak to the person unless the initial attorney/client relationship is officially terminated. I would suggest that you call your lawyer and request a meeting to advise him or her of your concerns. This will often resolve the issue, and your case will proceed to resolution. If speaking to your lawyer does not resolve your concerns, you may wish to consider other options at that time. Thanks for the question!


Q:  Would you recommend calling an attorney at the scene of the accident?

A:  In my opinion, assuming you were not at fault in the collision, it is not necessary that you call a lawyer while at the scene. In fact, attorneys for the at-fault party may attempt to use such a call against you later in the claims process. First and foremost, your health is most important. You should first seek proper medical attention. After doing so, you should then consider calling a lawyer for advice.


Q:  It is necessary to have a physical injury to bring a personal lawsuit?

A:  A lawsuit can be brought for a host of reasons. However, if the suit is based on "personal injury", there must be either physical or mental damage suffered by the Plaintiff. Thank you for the question.


Q:  Should you call a personal injury attorney while at the scene of an accident you were injured at?

A:  In my opinion, assuming you were not at fault in the collision, it is not necessary that you call a lawyer while at the scene. Q:  What if the other person’s insurance company contacts me for a recorded statement after an accident?

A:  Never give a recorded statement to anyone, specifically including the at-fault insurance company, without seeking the advice of a lawyer! Depending upon the facts involved, your lawyer can best advise you on whether such a statement should be provided. Thanks for the question. 


Q:  Can I still file a law suit if I didn't go to the doctor right away after an accident?

A:  Yes. However, the longer time gaps between the collision and the treatment can be detrimental to your claim. Q:  Would I be able to hire you for a claim that happened out of the state of Georgia? Thanks!

A:  Yes. The location of the event does not always deternime where the claim will be brought. However, if litigation needs to be filed in another state, it may be necessary for me to associate counsel from that state. There are many factors to be considered. Q:  Do all personal injury claims have to go to trial?

A:  No. In fact, most personal injury claims settle short of an actual trial. Generally, your lawyer and the insurance company will engage in settlement discussions before a lawsuit is filed. It is up to you as the client to determine if you would like to accept that offer or reject the offer and pursue a lawsuit. Even if the offer is rejected and a lawsuit is filed, the possibility of settlement remains, particularly through a process known as mediation. If the insurance company never makes an offer that you are willing to accept, then the case goes to an actual trial. Thanks for the question.


Q:  What if the person that caused my injury does not have insurance?

A:  Assuming you are referring to injuries in a car wreck, the most common avenue of recovery in this circumstance would be uninsured motorist coverage. This is insurance coverage offered through your insurance carrier. The coverage is optional so you will need to check with your agent to see if you purchased this type of coverage. Also, you can sue the person that caused your accident regardless of whether he or she carried insurance. However, the likelihood of recovering damages for your injuries is greatly reduced. Q:  How Does Negligence influence personal injury suits?

A:  The simple answer is that generally someone must have been negligent in causing you an injury (through their actions or their omissions) which would lead to a potential personal injury suit.
