U.S. Marshals apprehend suspect in Fulton County

A man wanted regarding a rape and kidnapping Jan. 5 was arrested over the weekend in Fulton County.

Barry Lynn Rutherford, of Chestnut Street in Metter, is being held without bond in the Candler County Jail on charges of battery, kidnapping and rape, said Candler County sheriff’s Capt. Justin Wells.

On Jan. 5 around 1:40 a.m., Deputy Brandon McGahee responded to Chestnut Street, where he met with a female victim who said she was assaulted and forcibly taken to “another location in Candler County against her will” during a domestic dispute, Wells said.

While investigators continue to actively pursue the case, he said there was “no indication firearms were involved.”

He did not disclose details about the reason for the dispute or the extent of the victim’s injuries.

Rutherford, 30, apparently fled the area after the incident and was apprehended by the U.S. Marshals Service in Fulton County, where he was picked up on the Candler County warrants as well as “an additional warrant for parole violation,” Wells said.
