Portal man charged in rape, burglary

A Portal man is behind bars without bond after police charged him with burglary and rape.
    Statesboro Police Det. Terry Briley said Jacob Rodney Wiggins, 40, McPhatter's Lane, Portal, entered a second-story Mikell Street residence Saturday night around 8:20 p.m. and without permission, then proceeded to have sexual intercourse with a woman who was "not capable of consent" to the act.
    The victim was asleep and "unresponsive to his advances, and was unable to say no," he said. Wiggins then "decided to take advantage of the victim."
    During the incident, two witnesses walked into the residence and caught Wiggins in the act. Knowing the victim was not in a condition to give consent, they called police, Briley said.
    Patrol officers located Wiggins after a description was given, and when he was captured and taken in for questioning, he admitted having had sexual intercourse with the victim, Briley said.
    He and the victim knew each other, he said.
    Wiggins was charged with burglary because he entered the home without permission, and also charged with rape. He was taken to the Bulloch County Jail, where he remains without bond, Briley said.
